PLEASE READ THE FOLLOWING ELIGIBILITY REQUIREMENTS CAREFULLY:
The Ugliest Kitchen Contest is open to homeowners within the WXRV listening area.
No purchase is necessary to win.
Employees of WXRV-FM the RIVER, its licensee, its corporate parent, Northeast Broadcasting, participating sponsors/promotional partners, affiliated advertising agencies, other radio stations in the Boston/Portsmouth/Manchester area and members of their immediate families are ineligible to participate or win.
Participants must own and reside in the home where the kitchen is located. (One entry per household). Entrants must be 21 years or older. Contestants are required to provide truthful information and WXRV, Plaistow Cabinet and Andover Equity Builders will reject and delete any entry that it discovers to be false or fraudulent.
Failure to comply with the contest rules may result in a contestant's disqualification solely at the discretion of WXRV, Plaistow Cabinet Company, and Andover Equity Builders.
Contestants may enter on-line at mykitchenisugly.com, or by mailing submissions to WXRV, 30 How Street, Haverhill, MA 01830.
Entries must be received by 5pm on May 1, 2009.
PRIZE: One (1) winner will receive a kitchen package with a retail value of $25,000 consisting of the following:
· Disconnection of sink, dishwasher, range, microwave and refrigerator if required. Disposal of existing appliances is the responsibility of the Owner / Winner.
· Removal of existing cabinets, counters and flooring (up to 150 sq.ft.), including disposal of same
· Removal and replacement of up to 320 sq.feet of interior wall and ceiling surfaces. New walls will be ½” standard drywall, taped and finished. Walls will be smooth, ceilings will be textured.
· Plumbing is included for the installation of a new sink, garbage disposal, dishwasher, refrigerator waterline, and gas range. The installation of a new water or gas services, or upgrade of the existing water or gas services will be at an additional cost.
· Electrical is included for standard appliance circuits for the dishwasher, garbage disposal, refrigerator, and range; (5) standard counter outlets; (4) recessed lights and (1) ceiling fixture. Upgrades to the existing electrical service or electrical panel, or the installation of an electrical sub-panel will be at an additional cost.
· New interior trim will be 2 ½” colonial casing and is included for (1) window and (1) door; baseboard will be 3 ½” colonial baseboard and is included up to 24’.
· Interior painting is included for 150 sq.ft. of ceiling and 400 sq. ft of wall space. Ceiling will receive (1) coat of primer and (1) coat of flat white ceiling paint. Walls will receive (1) coat of primer and (2) coats of satin finish wall paint
· Cabinetry will be Cabico brand cabinetry, and is included up to a retail value of $6500.00. Pricing is based on proposed kitchen plan. Changes, additions, deletions, and product selections will affect the final pricing of the cabinetry to be provided. Brushed nickel knobs for cabinet doors and draws are included.
· Cabinet installation is provided based on the proposed kitchen plan. Changes to the cabinet layout may affect the installation price and may result in additional costs for the Winner / Owner.
· 35 sq.ft. of granite counter and backsplash is included form selections provided by Plaistow Cabinet Company. Alternate counter top selections may affect the final price of the counters and may result in additional costs for the Winner / Owner.
· A C-Tech brand 18 gauge bowl and ½ undermount stainless steel sink and C-Tech pull out faucet with brushed nickel finish are included.
· Appliances are included from C & K Appliance, Andover, MA, with a retail value of $1000.00.
· Vinyl flooring is include form up to 150 sq. ft of flooring, with a maximum installed value of $400.00
Miscellaneous
All permit fees are the responsibility of the Owner / Winner
No windows, doors, or exterior work are included in this prize.
The installation of any insulation is not included in this prize.
The venting of any exhaust hoods or appliances is not included in this prize.
No cash value will be substituted for work that is not completed. Any additional costs for materials or labor, above and beyond what is included in the Grand Prize shall be paid in advance of the product being provided, or the work being completed.
WXRV nor the sponsors take responsibility for any site conditions or hidden elements which increase the cost of the project. Repair or restoration or other hidden conditions will be the responsibility of the homeowner.
The following will be required of the Winner:
1. To pay for and obtain any general building permits that may be required by the municipality in which they reside, or to reimburse Plaistow Cabinet Company and/or Andover Equity Builders for any permit fees, which may be required to complete the project, paid to the municipality in which the winner resides
2. To Reimburse the plumbing and electrical contractors for fees paid to obtain electrical and plumbing permits, which may be required to complete the project, or that may be required by the municipality in which the winner resides.
3. To compensate Plaistow Cabinet Company and/or Andover Equity builders for additional work, which may be required by the local building officials, needed to bring the kitchen area up to current building, electrical and plumbing code requirements.
4. It is also recommended that the Winner have an additional $3000.00 - $5000.00 available to correct any hidden conditions, or work required to comply with current building, plumbing and electrical codes, which work is not included within the Grand Prize.
ODDS OF WINNING: Odds of winning depend on the number of eligible entries received.
General Information
WINNER NOTIFICATION AND ACCEPTANCE
Ten (10) Semi-finalists will be notified by telephone on or about May 9, 2009. The 10 Semi-finalists will need to make their home available for an in home visit between May 10th – May 15th, where pictures will be taken by our representatives.The Grand Prize Winner will be announced and notified at a live apprearance by WXRV at Plaistow Cabinet Company, 56 Newton Road, Plaistow, NH 03865 on Saturday June 6, 2009 from noon to 2pm. All finalists must be present to qualify for the Grand Prize. The Grand Prize Winner may waive his or her right to receive the Grand Prize. The Grand Prize is non-assignable and nontransferable and the kitchen renovation project may only be performed at the residence depicted in the Grand Prize Winner's entry. No cash equivalents or substitutions allowed by Grand Prize Winner. The Grand Prize and individual components of the Grand Prize package are subject to availability and Sponsor reserves the right to substitute any prize or prize component with a prize or component of equal or greater retail value.
The Winner must provide proof of ownership of the home by providing a copy of the most recent tax bill from the home’s local community/municipality illustrating the home owner’s name and address. Homeowner must also provide a copy of a valid form of identification (i.e., a valid driver’s license or passport).
The Grand Prize Winner is solely responsible for all taxes on the Grand Prize. The Sponsor will issue an IRS 1099 – Miscellaneous Income form, to be given to the winner upon completion of the project for the full value, up to $25,000, for all materials and labor, which have been provided to the winner at no charge. This income will need to be reported as income on the winners 2009 federal, state and local tax returns as required by law. The Grand Prize Winner will be required to complete an affidavit of eligibility, and a liability and publicity release (except where prohibited by law), which must be returned by May 26, 2009. Failure to timely sign and return the affidavit or release, or to comply with any term or condition of these Official Rules, may result in the Grand Prize Winner's disqualification, the forfeiture of his or her interest in the Grand Prize, and the award of the Grand Prize to a substitute winner. Except where prohibited by law, acceptance of any prize constitutes the Grand Prize Winner's consent to the Sponsor's use of his or her name, biographical information, voice and likeness in any media for any commercial, programming or promotional purpose (including, without limitation, use on the web sites of WXRV, Plaistow Cabinet Company, and Andover Equity Builders) without any compensation and for purposes of complying with all applicable federal, state and local laws and regulations. If the Grand Prize is not won and claimed by an eligible winner in accordance with these Official Rules, the Grand Prize may not be awarded and may remain the property of Sponsor.
LIMITATION ON LIABILITY
WXRV, Plaistow Cabinet Company, and Andover Equity Builders are not responsible for any incorrect or inaccurate information, whether caused by Web site users or by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error, which may occur in the processing of submissions in the Contest. WXRV, Plaistow Cabinet Company, and Andover Equity Builders are not responsible for and WXRV, Plaistow Cabinet Company, and Andover Equity Builders may disqualify entries that are lost, late, incomplete, invalid, illegible, misdirected, failed transmissions, partial or garbled transmissions, whether the result of human, mechanical, electronic error or whether in the transmission, submission or processing of the entries or otherwise. WXRV, Plaistow Cabinet Company, and Andover Equity Builders assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or
WXRV, Plaistow Cabinet Company, and Andover Equity Builders are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, failure of email or entrants on account of technical problems or traffic congestion on the Internet or at any on-line or combination thereof, including injury or damage to participants or to any other person's computer related to or resulting from participating or downloading materials in this Contest. WXRV, Plaistow Cabinet Company, and Andover Equity Builders reserve the right at their sole discretion to cancel, terminate, modify or suspend the Contest.
By entering, participants release and hold harmless WXRV, Plaistow Cabinet Company, and Andover Equity Builders and their affiliates and their respective directors, officers, employees and agents from any and all liability for any injuries, loss or damage of any kind to persons, including death, or property damage resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize, participation in this promotion, or while traveling to, preparing for, or participating in any prize-related activity. Entrants further agree that no claims, judgments or awards shall exceed the amount of the contest prize and under no circumstances shall include attorney’s fees; nor shall any entrant be permitted to obtain awards for punitive, incidental, consequential or other similar damages or have any damage awards multiplied or increased for any reason.
By accepting any prize, the entrant agrees to release WXRV, Plaistow Cabinet Company, and Andover Equity Builders from any and all liability and hold it, its principals, directors, officers, employees and agents, harmless from and against any and all claims, demands or actions arising out of entrant's acceptance, receipt or use of any prize.
The Ugly Kitchen contest is sponsored by WXRV, Plaistow Cabinet Company, and Andover Equity Builders. The decision of WXRV, Plaistow Cabinet Company, and Andover Equity Builder regarding the selection of winners, the interpretation of these rules, and all other aspects of the contest shall be final and binding in all respects. WXRV, Plaistow Cabinet Company, and Andover Equity Builders will not be responsible for typographical, printed or any inadvertent errors in these official rules, material or announcements relating to the contest.
CONDUCT
By participating, Contestants agree to be bound by these Official Rules and by the decisions of Sponsors and the Contest Judges appointed by Sponsors which shall be final in all respects. Sponsors reserve the right at their sole discretion to disqualify any persons found tampering with the entry process or the operation of the contest or on-line; to be acting in violation of the Official Rules; or to be acting in a non-sportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person.
In the event the Contest is compromised by tampering or any other cause beyond the reasonable control of Sponsors which corrupts or impairs the administration, security, fairness or proper operation of the Contest, Sponsors reserve the right in their sole discretion to suspend, modify or terminate the Contest. CAUTION: ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WXRV, PLAISTOW CABINET COMPANY AND ANDOVER EQUITY BUILDERS RESERVE THE RIGHT TO SEEK DAMAGES FROM ANY SUCH CONTESTANT TO THE FULLEST EXTENT PERMITTED BY LAW.
The invalidity or unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.
